• A. Litigation Strategies & Case Management.
• Lead and oversee litigation matters, including civil, criminal, commercial, debt recovery, and special cases.
• Represent the company in court proceedings, negotiations, mediations, and settlement discussions as required.
• Develop litigation strategies and provide legal guidance (i) to mitigate business and legal risks., (ii) to protect the Company's interests and (iii) to maximize legal recoveries.
• Manage the entire litigation lifecycle from case assessment through judgment and enforcement.
• Conduct legal risk assessment and recommend appropriate litigation or settlement strategies.
• Monitor case progress, budget, litigation costs, and legal provisions.
• Manage and coach a team of litigation lawyers, ensuring effective case handling and timely resolution.
• Review and approve legal documents, court filings, and legal opinions.
• Collaborate with internal stakeholders and manage external law firms to drive successful legal outcomes.
• Monitor legal developments and ensure compliance with applicable laws, regulations, and court procedures.
• Prepare case updates, risk assessments, and management reports for senior leadership.
• B. Non-Performing Loan (NPL) Litigation.
• Manage NPL recovery litigation and enforcement proceedings.
• Evaluate accounts for litigation suitability and recommend legal actions.
• Supervise filing of debt recovery claims, execution proceedings, bankruptcy matters, and rehabilitation-related disputes.
• Drive recovery outcomes and optimize litigation recovery rates.
• Develop legal strategies to improve collection effectiveness and reduce losses.
• C. Fraud Litigation & Financial Crime Matters.
• Lead fraud-related litigation involving identity theft, stolen/lost cards, unauthorized transactions, fraudulent loans, scam activities, forgery, misappropriation, and cyber-enabled fraud.
• Coordinate with law enforcement agencies, prosecutors, regulators, and investigation teams.
• Advise business stakeholders on legal actions against fraudsters and third parties.
• Support evidence gathering and criminal complaint processes.
• D. Labour & Employment Disputes.
• Manage labour court cases and employment-related disputes.
• Advise HR and management on legal risk mitigation arising from employment matters.
• Handle employee claims involving termination, misconduct, disciplinary actions, discrimination, harassment, and employment benefits.
• Represent the Company in labour courts, labour departments, and mediation proceedings.
• E. Civil & Commercial Litigation.
• Handle contractual disputes, tort claims, shareholder disputes, consumer claims, property disputes, and other civil litigation.
• Develop defense and prosecution strategies.
• Negotiate settlements where commercially appropriate.
• Manage mediation and alternative dispute resolution processes.
• F. Criminal Proceedings.
• Handle criminal complaints and criminal proceedings involving the Company's interests.
• Prepare and review criminal complaints, witness statements, and supporting evidence.
• Liaise with police officers, public prosecutors, courts, and governmental authorities.
• Represent the Company in criminal investigations and proceedings.
• Bachelor's Degree or higher in Law.
• Valid Lawyer License in Thailand.
• 8-10 years of litigation experience, with at least 2 years in a team leadership role.
• Strong expertise in litigation, dispute resolution, debt recovery, and enforcement proceedings.
• At least 5 years of experience in the banking, financial services, fintech, or consumer lending industry.
• Strong leadership, negotiation, stakeholder management, and analytical skills.
• High integrity, sound judgment, and ability to manage complex legal matters.
